These Terms of Service ("Terms") regulate your use of bagpipes.pro and its Services. By accessing or using the Services, you ("user") agree to comply with these Terms and our Privacy Policy. If you disagree with any provision, do not use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. Minors between 13 and 18 require parental/guardian consent.
You warrant that you have the legal authority to enter into these Terms (or have parental/guardian consent if applicable).
We may refuse service or terminate accounts that violate eligibility rules.
2. Account Rules
To access core features (e.g., clan creation, multiplayer battles), you must create an account with accurate, complete, and current information.
You are responsible for safeguarding your account credentials (username, password) and all activities under your account.
Account sharing, lending, or transferring to third parties is prohibited. We may suspend or terminate accounts for unauthorized access or sharing.

3. User Conduct & Game Rules
You agree to use the Services lawfully and in accordance with these Terms. Prohibited actions include:
Using cheats, hacks, or exploits (e.g., infinite resources, invincibility in battles) to gain an unfair advantage.
Modifying game files or using third-party software to alter battle mechanics or access restricted historical content.
Harassing, bullying, or discriminating against other users (e.g., toxic chat in alliance forums, targeted griefing of kingdoms) or our staff.
Posting or sharing inappropriate content (e.g., explicit material, hate speech) in kingdom descriptions or clan names.
Infringing on third-party intellectual property (e.g., using copyrighted historical images in custom clan banners).
4. Purchases & Virtual Content
Virtual content (e.g., clan upgrades, battle gear, premium resources) is licensed to you, not sold. You have no ownership rights, and virtual items cannot be transferred, refunded, or exchanged unless required by law.
Refunds are granted only in cases of technical failures (e.g., premium content not unlocking) and must be requested within 7 days of purchase.
We reserve the right to modify, discontinue, or remove virtual content at any time, with or without notice.
5. Intellectual Property
All content on the Services (e.g., game code, graphics, historical lore, trademarks) is owned by us or our licensors and protected by intellectual property laws.
You may not copy, distribute, modify, or create derivative works of any Service content without our explicit written permission.
You retain ownership of user-generated content (e.g., clan names, forum posts) but grant us a non-exclusive, worldwide, royalty-free license to use, display, and promote such content in connection with the Services.
6. Limitation of Liability
The Services are provided "as is" without warranties of any kind (express or implied), including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services (e.g., loss of kingdom progress, account suspension, or device damage), even if we are advised of the possibility of such damages.
Our total liability to you shall not exceed $85. This limitation applies regardless of the legal theory (contract, tort, or otherwise).
7. Termination
We may suspend or terminate your account and access to the Services at any time, with or without notice, if you violate these Terms, engage in prohibited conduct, or for any other reason in our sole discretion.
Upon termination, your account and associated data may be deleted (subject to data retention laws), and you lose access to virtual content and game progress.

8. Governing LawThese Terms are governed by the laws of the State of Massachusetts, United States. Any disputes arising from these Terms or the Services shall be resolved through arbitration in Boston, MA, under the rules of the American Arbitration Association.
